Polizza Decennale Postuma (10-Year Posthumous Insurance)

An insurance policy that developers are required by law (D. Lgs. 122/2005) to provide to buyers of newly built homes, covering serious construction defects that may become apparent within 10 years after completion. This decennial insurance protects the buyer against collapse or serious structural issues in the building. The policy typically starts from the completion of works (or from the sale deed date) and benefits subsequent owners too within the 10-year period. It usually covers structural integrity, major construction defects, and damage from total or partial collapse due to design or construction flaws or soil defects. When buying a new build from a developer, at the rogito the notary will ensure the handover of this insurance certificate to the buyer. It is a safeguard in addition to the standard warranties. If a defect covered by the policy occurs (for example, the foundation sinks causing severe cracks), the owner can claim directly with the insurance company for repair costs if the developer refuses or has gone bankrupt.
