The default marital property regime in Italy for couples married without choosing otherwise (since 1975). Under comunione dei beni, most property acquired during marriage by either spouse becomes joint property, owned 50/50 . For example, if a husband buys a house while in comunione, the wife automatically owns half, even if only the husband’s name is on the deed (it will be indicated the purchase is in comunione). However, certain assets remain personal (like those owned before marriage or inherited individually). This is important for buyers – if a married seller is in comunione, the spouse must also sign the deed or formally consent. Spouses at the time of marriage can opt for separazione dei beni (separation of property) instead, keeping acquisitions separate.
