Mutuatario (Borrower)

The person (or entity) who receives a loan in a mutuo contract and is obliged to pay it back. In a mortgage context, the mutuatario is the homeowner taking the loan. The loan contract will list the mutuatario’s details and repayment schedule. The mutuatario is personally liable for the debt – if they fail to pay, the bank can take legal action to foreclose on the property (since it’s mortgaged) and also pursue the mutuatario’s other assets if the sale doesn’t cover the debt. Italian banks will assess a mutuatario’s income, age, and credit history. Usually, the borrower’s monthly payment should not exceed about one-third of their net income. If there are co-borrowers, each is jointly responsible. The term debitore (debtor) is also used. Once the mutuatario fully pays off the mutuo, they can obtain a release (cancellazione) of the mortgage.
