Provvigione (Broker’s Commission)

The fee paid to the real estate agent or broker for their services in facilitating a sale or lease. In Italy, the provvigione is usually due by both seller and buyer in a sale, as per custom (often each pays around 2–3% + IVA of the sale price, but it’s negotiable and can vary by region or price level). For rentals, the commission might be one month’s rent from each side, or other arrangements. According to Civil Code art. 1755, the agent earns the commission when the deal is concluded due to their mediation (for instance, when a preliminary contract is signed through the agent’s efforts) . The commission amount or percentage should be agreed in advance (usually in the agent’s engagement contract or clearly posted at the agency). It’s important to note that if a buyer and seller are introduced by an agent and later complete the deal behind the agent’s back, the agent can still legally claim their commission. Agents typically ask both parties to sign a declaration in the final deed about whether an agent was involved and commission paid, to document their compensation for tax and legal purposes.
