Pertinenza (Appurtenance)

An accessory thing that is intended to serve or adorn a principal property in a durable way . In real estate, pertinenze are items like a garage, cellar, parking space, garden, or storage room that is accessory to a main housing unit. Under Civil Code art. 817, a sale of the main property generally includes its pertinenze unless explicitly excluded . For example, if you buy an apartment that has an assigned garage as a pertinenza, the garage is automatically transferred with the apartment (and typically indicated in the deed as pertinenza dell’unità). Pertinenze enjoy the same tax treatment as the main home in many cases: e.g., when you buy your prima casa, you can also get tax benefits on up to three pertinenze (one garage C/6, one storage C/2, one open shed C/7). A pertinenza can be sold separately only if it’s expressly severed from being a pertinenza (consent of owner and compliance with zoning). The concept ensures accessory units remain linked legally to the primary unit they serve.
