Rogito (Notarial Deed of Sale)

Colloquial term for the final deed of sale – the atto pubblico notarile that transfers ownership from seller to buyer. Rogito literally means “act” and as verb rogitare refers to the notary drafting a deed. At the rogito stage, all parties (or their representatives by procura) meet at the notary’s office to sign the deed. The notary will have prepared a draft, done all checks (title, liens, identities, etc.), and usually collected the remaining balance of the price (often via cashier’s checks or arranged bank wiring). During the rogito, the notary reads the contract aloud, ensures both parties understand their declarations, then the parties sign along with the notary. The price paid is declared in the deed (as required by law). Keys are handed over, and the buyer formally takes possession unless otherwise agreed. Immediately after, the notary will register the deed and record it in the Conservatoria. The rogito is the definitive moment ownership transfers (assuming the contract was valid and now made in required form) . Notaries often assist in drafting condizioni sospensive if any (though usually all conditions must be fulfilled by this point). After the rogito, the buyer is the new owner, the seller receives their money, and the real estate agent (if any) gets their commission if not already paid. In sum, “fare il rogito” means to close the deal with the notary.
